Documents that are copyrighted, legally drafted or not available to the public

Smokeball does not provide the following types of documents in the Smokeball Precedent Library:

1. Documents that are protected by copyright
2. Documents that are legally drafted
3. Documents that are not publicly available on the source’s website

If you have a copy of any of the above types of documents, you can import and automate the document into your Firm’s Precedent Library for your personal use.

Documents that are protected by copyright

Smokeball does not provide the following documents in the Smokeball Precedent Library as they are protected by copyright:

• Australian Institute of Conveyancers (AIC) SA Division’s Contract for Sale. The Contract of Sale is provided by The Law Society of South Australia in their Standard Property Documents.
• Law Institute of Victoria’s (LIV) Contract for the Sale of and Purchase of Land, Contract of Sale of Business, Commercial Lease and Transfer of Lease. These and other documents that require payment or membership can be obtained directly from the LIV's Forms, Templates & Precedents.
• The NSW Law Society’s Contract for the Sale of and Purchase of Land, Contract for the Sale of Business, Commercial Lease including Annexure B. These and other documents that require payment or membership can be obtained directly the Law Society's Legal Documents shop.
• Real Estate Institute of Queensland’s (REIQ) Contract for Sale (Contract for Houses and Residential land), Contract for Residential Lots in CTS and Commercial Tenancy Agreement. These and other documents can be purchased from the REIQ Real Estate Shop.

Any other documents that display a copyright clause or require a payment and/or membership from the provider.

Documents that are legally drafted

Smokeball does not provide the following documents in the Smokeball Precedent Library as they are legally drafted:

• Deed of Assignment of Lease
• Discretionary Trust Deed with clauses
• Licence Agreement/Licence to occupy before settlement
• Requisitions on Title
• Replies to Requisitions
• Special Contract Conditions

Documents that are not publicly available on the source’s website

There are some forms that are provided by authorities upon request but are not publicly available for download directly from their website, therefore Smokeball does not provide them. An example of these are the Discharge Authorities from Lenders.
