Property (WA)

The Property (WA) matter type provides the necessary contact cards and layouts for the division of assets and liabilities in a financial settlement after a relationship ends, whether or not proceedings commence in the Family Court of Western Australia.

Common Contact Cards and Layouts

The following Contact Cards and Layouts appear by default on a Property (WA) matter:

  • Client and Client Details
Enter the role of your Client i.e. applicant or respondent, and their relationship to the children under Client Details.
  • Other Side, Other Side Details and Other Side’s Solicitor
Enter the role and relationship of the Other Side under Other Side Details.
  • Relationship Details
Enter the parties’ cohabitation, marriage, separation and divorce details.
  • Case Details
Enter the details of the court, proceedings, mediation details, final orders and any financial disclosure sent or received.

Uncommon Contact Cards and Layouts

Uncommon contact cards are also available for selection on a matter-by-matter basis, such as:

  • Valuer
  • Client’s Super Fund/Other Side’s Super Fund

Learn how to select uncommon contacts from within the matter.

If you don’t see a contact card needed for this matter type, you can submit a request for it to be added to Smokeball.

Precedent Library

The Property (WA) matter provides access to the Family (WA) Precedent Profile. This pre-set Precedent Library folder contains non-legally drafted precedents for everyday use, together with shortcuts to commonly used documents found under Court & Authority forms:

If the Precedent Profile does not appear in the Precedent Library, please ensure that you have subscribed to the Precedent Profile.

If you don’t see a commonly used and publicly available form and you would like it added to Smokeball, you can request a form.

Precedent Spotlight

Smokeball provides an automated:

  • Initiating Application
  • Case Information Affidavit
  • Affidavit - General

among other forms and brochures obtained from the Family Court of Western Australia website.

Recent Updates

The Western Australia Property Matter Type was recently converted from a Non-Localised Matter Type to Western Australia Localised Matter Type. Please see our What to expect when Smokeball localises a Matter Type to see how these changes may apply to you.
